1. Definitions
Customer(s): any individual or legal entity wishing to purchase or use the Products or Services provided by Ovatheme.
Plugin: WordPress Plugins developed by Ovatheme.
Theme: WordPress Themes developed by Ovatheme.
Products: WordPress Plugins and WordPress Themes developed by Ovatheme.
Service: Support, Updates, and Customizations provided by Ovatheme.
Support: The technical assistance and/or maintenance services provided by Ovatheme, including help with installation, configuration, and troubleshooting issues directly related to the Product, on the condition that such assistance does not require rewriting or customizing a substantial part of the existing Plugin or Theme.
License: The right granted to the Customer to use a Product on one or more domains, as specified at the time of purchase, subject to these Terms & Conditions.
Update: Improvements, bug fixes, and feature upgrades made to Plugins and Themes by Ovatheme, provided as part of the Support service during the active License period.

2. Price and Payment
2.1 Pricing
The prices and specifications of the Products offered by Ovatheme may be viewed at https://ovatheme.com. Prices are shown in USD.
Ovatheme reserves the right to revise its pricing at any time without prior notice. Price changes will not affect Products already purchased.
2.2 Payment Processing
All payments made on https://ovatheme.com are processed by Freemius.com, which acts as our Merchant of Record for all orders. This means Freemius is the authorized reseller and is responsible for processing your payment, issuing your invoice/receipt, handling applicable sales tax and VAT, and providing customer support related to your payment transaction.
Freemius accepts major credit and debit cards, PayPal, and other regionally available payment methods. By completing a purchase on our Website, you also agree to Freemius’s Buyer Terms and Conditions.
Products remain the property of Ovatheme until full payment has been confirmed.
3. License Policy
3.1 License Duration
After payment is completed, the Customer receives a License for each purchased Product. This License grants the Customer 12 months of access to:
- Download the Product files
- Receive Product Updates
- Receive Support from the Ovatheme team
When the 12-month period expires, the Customer will receive a notification with the option to renew the License for continued Updates and Support. Products already downloaded will continue to function after License expiration, but will no longer receive Updates or Support without renewal.
3.2 Domain Usage
Each License is valid for use on a specific number of domains, selected by the Customer at the time of purchase (available options: 1, 2, or 3 domains). The number of domains licensed is stated on the Customer’s order and invoice.
Using a Product on more domains than covered by the purchased License is a violation of these Terms & Conditions. Customers who need to use a Product on additional domains must purchase an additional License or upgrade to a higher domain-count package.
Staging, testing, and development environments not accessible to the public may be used without counting toward the domain limit, provided the live/production use stays within the licensed domain count.
4. Refund Policy
Refund requests are handled according to our Refund Policy. Please review this page for full details on eligibility and the request process before purchasing.
5. Privacy
The personal information required to process orders placed through https://ovatheme.com — including the Customer’s name, email address, and billing details — is collected and processed in accordance with our Privacy Policy.
Ovatheme does not directly collect or store payment card details. All payment information is collected and securely processed by Freemius.
6. Item Support Policy
Support scope, response times, and what is/is not covered under Support are detailed in our Item Support Policy.
7. Copyright and Intellectual Property Rights
All Products (Themes, Plugins, and their associated design, code, graphics, and documentation) sold on https://ovatheme.com are the intellectual property of Ovatheme, except where third-party assets (such as fonts, icons, or images) are separately licensed and credited.
Purchasing a License grants the Customer the right to use the Product as described in Section 3, but does not transfer ownership of the underlying code, design, or intellectual property. The Customer may not:
- Resell, redistribute, or sublicense the Product, in original or modified form, as a standalone item
- Claim authorship of the Product
- Use the Product’s code to create a directly competing theme or plugin offered for sale or distribution
All rights not expressly granted under these Terms & Conditions are reserved by Ovatheme.
8. Limitation of Liability
The Website and all Products are provided on an “as is” basis. While Ovatheme makes every reasonable effort to ensure Products function as described, Ovatheme makes no warranty that Products will be error-free or uninterrupted.
To the maximum extent permitted by law, Ovatheme shall not be held liable for any indirect, incidental, or consequential damages arising from the use of, or inability to use, our Products or Website, including but not limited to loss of data, revenue, or business opportunities.
9. Updates to These Terms & Conditions
Ovatheme reserves the right to update, modify, or amend these Terms & Conditions at any time. Changes take effect immediately upon posting to https://ovatheme.com/terms-of-service/. Continued use of our Website or Products after changes are posted constitutes acceptance of the revised Terms & Conditions.
10. Governing Law
These Terms & Conditions are governed by the laws of Vietnam. Any dispute arising from the use of our Products or Website shall be subject to the jurisdiction of the competent courts of Vietnam, without prejudice to any mandatory consumer protection rights the Customer may have under the laws of their own country of residence.
